1.1 This agreement constitutes the legally binding terms between users of the virax.ai website and the virax.ai platform. Throughout this document, "virax.ai" refers collectively to the website, services, systems, and all related features provided by virax.ai.

1.2 These Terms apply to every individual or entity that uses virax.ai's AI image and video generation services and are accepted during the account registration process.

1.3 If you do not agree with these Terms, you are not permitted to access or use the services and must discontinue use immediately and remove your account if one has already been created.

2.1 Creating an account is mandatory in order to access virax.ai's AI-powered image and video generation features.

2.2 Accounts are intended for individual use only and may not be shared. You are responsible for maintaining reasonable security over your login credentials.

2.3 All activity conducted through your account is your responsibility, and such activity must comply with these Terms.

2.4 virax.ai reserves the right to suspend or terminate accounts that violate these Terms.

2.5 In the event of account termination, virax.ai does not guarantee continued access to stored data, nor does it guarantee refunds for any unused or purchased credits.

2.6 While virax.ai endeavors to provide reliable and scalable services, uninterrupted access or specific uptime levels are not guaranteed.

2.7 virax.ai shall not be held responsible for any losses, damages, or liabilities resulting from the use of the services or from the use of any images or videos generated through the platform.

2.8 virax.ai may update or revise these Terms at its discretion and will make reasonable efforts to inform users of such changes.

3.1 virax.ai operates on a pay-as-you-go basis. Users may purchase virtual usage units known as "Credits," which are required to generate images and videos.

3.2 Credits may be used solely for generating images and videos within the virax.ai platform.

3.3 Credits have no cash value and cannot be exchanged for money or other products or services.

3.4 Credits are non-transferable and may not be shared or reassigned to other users.

3.5 Credits do not expire and will remain available in your account until they are consumed.

3.6 All listed prices are denominated in U.S. Dollars and exclude applicable taxes, which may be charged separately by our payment processor.

3.7 virax.ai reserves the right to adjust credit pricing at any time, with reasonable notice provided to users.

4.1 Refund Policy for One-Time Credit Purchases

- If a refund request is made within seven (7) days of purchase and no credits or services have been used, a full refund may be issued.

- If credits or services have been partially used, a partial refund may be considered based on the remaining unused credits.

- Exceptional cases: If verified, ongoing technical issues caused by virax.ai prevent you from using purchased credits entirely, virax.ai may issue a full or proportional refund. Users must promptly contact customer support and provide relevant information.

4.2 Non-Refundable Circumstances

Refunds will not be provided in situations including, but not limited to:

- Requests submitted after the seven (7) day refund period

- Dissatisfaction with AI output style, quality, or creativity (unless the service is fundamentally unusable due to platform failure)

- User errors or failure to follow provided instructions

- Device, browser, or network-related issues

- Poor results due to incorrect, vague, or policy-violating prompts

- Excessive or intentional use of services prior to requesting a refund

- Violations of these Terms

- Service disruptions caused by force majeure events (e.g., natural disasters or large-scale cyber incidents)

- Change of mind after partial or full use of services

5.1 virax.ai does not claim ownership or copyright over AI-generated images or videos. Users may use generated content for both commercial and non-commercial purposes.

5.2 AI-generated outputs may be unpredictable and are not guaranteed to precisely reflect input prompts or meet any particular standard of quality.

5.3 Users must not generate content that is illegal within their jurisdiction or place of residence.

5.4 Access to generation services is permitted only through the official virax.ai website. Automated or non-human access methods are prohibited.

5.5 Generated content must not be used as a replacement for professional services, including but not limited to legal, financial, or medical advice.

5.6 You bear full responsibility for the content you generate and for any use of such content.

6.1 virax.ai collects and stores basic user information required for service operation.

6.2 Data Retention Policy

- Account-related data is retained while your account remains active

- Generated content may be temporarily stored or cached for processing and performance purposes

- Users may request data deletion by contacting support

- Deleted data, including accounts and generated assets, cannot be recovered

6.3 virax.ai employs industry-standard security practices to safeguard user data and privacy.

6.4 User-generated content remains private by default and is not shared unless explicitly authorized by the user.

7.1 By using virax.ai, you agree that you will not:

a. Alter, modify, translate, or adapt any part of virax.ai

b. Reverse engineer, decompile, or attempt to derive source code from virax.ai

c. Bypass or interfere with security-related features

d. Access systems, networks, or data without authorization

e. Disrupt or impair the operation of the platform

f. Remove or obscure intellectual property notices

g. Violate any applicable laws or regulations

h. Use bots, scripts, or automation to access the service

i. Generate unlawful, abusive, harmful, or offensive content

You may not generate content that:

a. Is illegal, abusive, defamatory, hateful, or threatening

b. Promotes or facilitates criminal activity

c. Infringes intellectual property rights

d. Involves minors in inappropriate or exploitative contexts

e. Targets individuals or groups for harassment or harm

f. Violates privacy or publicity rights

g. Contains malicious software or harmful code

h. Is deemed objectionable or risky by virax.ai in its sole discretion

THE virax.ai SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND YOUR USE IS AT YOUR OWN RISK.

NO WARRANTIES OF ANY KIND ARE PROVIDED, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

virax.ai DOES NOT GUARANTEE THAT:

A. THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE

B. THE SERVICE WILL MEET USER EXPECTATIONS

C. GENERATED CONTENT WILL BE ACCURATE OR RELIABLE

D. DEFECTS OR ERRORS WILL BE CORRECTED

TO THE MAXIMUM EXTENT PERMITTED BY LAW, virax.ai SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICES.

You agree to indemnify and hold harmless virax.ai, its affiliates, officers, employees, and agents from any claims, damages, or expenses arising out of:

a. Your use of the services

b. Your breach of these Terms

c. Infringement of third-party rights

d. Content you generate through virax.ai

11.1 You may close your account at any time by contacting [email protected].

11.2 virax.ai may suspend or terminate accounts immediately if user conduct poses risk or harm to the platform, other users, or third parties.

11.3 Upon termination, access to all services will cease immediately.

11.4 Any unused credits will be forfeited upon termination.

These Terms shall be governed by and interpreted under the laws of the jurisdiction in which virax.ai operates, without regard to conflict-of-law principles.

virax.ai may revise these Terms at any time. Material changes will be communicated via email or through the website. Continued use of the services after changes take effect constitutes acceptance of the revised Terms.
